Longboat Key is an elegant resort community on a fragile barrier island in western Sarasota County (FL).
Spikowski Planning redrafted portions of the Town’s zoning code in 2013 and 2014 in response to court decisions that concluded the Town Commission had delegated too much discretionary authority to itself during the quasi-judicial rezoning process.
The first ordinance created a new procedure for allocating new tourist development rights approved in a referendum of Longboat Key residents. Ordinance 2013-07 was adopted in March 2013.
The second ordinance refined the Town’s ODP (outline development plan) process which had been designed for the incremental development of large master-planned communities. The ODP process has outlived its usefulness on Longboat Key and is due for replacement with zoning techniques that focus on improvements and redevelopment. However, due to timing issues, this ordinance clarified and improved the existing ODP process to make it comply with the court orders, and also made various refinements to clarify the code, eliminate inconsistencies, and address other pressing issues. Ordinance 2013-20 was adopted in June 2014.
